1. Agreement Overview
These Terms of Service (the "Agreement") are made between HEARTS in FOCUS ("we", "us", or "our") and the client ("you" or "your") for the wedding photography and videography services to be provided by HEARTS in FOCUS, as outlined in the signed contract. By booking our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not book our services.

2. Scope of Services
HEARTS in FOCUS will provide wedding photography and/or videography services as detailed in the contract, including but not limited to the capturing of photos and/or video footage on the day of your event, post-production editing, and the delivery of final products. Specific services, dates, times, and locations are agreed upon in the contract.

3. Cancellation & Refund Policy
Due to the personalized and time-sensitive nature of our services, we have a no-refund policy for services already rendered. Once the contract is signed and the deposit is paid, the deposit is non-refundable.

However, a refund will be provided if HEARTS in FOCUS is unable to perform the services as outlined in the contract due to unforeseen circumstances, such as equipment failure or extreme emergencies that prevent us from fulfilling the contract. This refund will be limited to the amount paid for the services we were unable to provide, and does not cover any other costs or damages.

4. Client Responsibilities
The client agrees to provide accurate event details and access to the event location as necessary for the services to be performed. Any changes to the agreed-upon schedule or location should be communicated in writing at least 14 days prior to the event date.

 

5. Copyright and Usage Rights
HEARTS in FOCUS retains full copyright of all photos and video footage created. You are granted a license to use the images and videos for personal, non-commercial purposes. We reserve the right to use the images and videos for promotional purposes, including but not limited to portfolios, websites, and social media, unless otherwise agreed in writing.

6. Client's Rights to Photos and Videos
You will receive edited photos and videos as specified in the contract. The number of images and/or video content, format, and delivery timeline will be detailed in the signed contract. You acknowledge that edits are at our discretion, and additional edits or requests outside of the agreed-upon services may incur additional charges.

7. Limitation of Liability
HEARTS in FOCUS will take all reasonable precautions to ensure the highest quality of service; however, in the event of unforeseen circumstances, we are not liable for damages, including but not limited to: loss of images or videos due to technical failure, natural disasters, or situations beyond our control. Our liability is limited to a refund as outlined above.

8. Force Majeure
In the event of circumstances beyond our control, including but not limited to extreme weather, natural disasters, illness, or government restrictions, we will work with you to reschedule the services. If rescheduling is not possible, a refund as outlined in Section 4 will apply.

9. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the state or jurisdiction in which HEARTS in FOCUS operates.

10. Changes to Terms
HEARTS in FOCUS reserves the right to modify these Terms of Service at any time. Any modifications will be communicated to the client and will apply to services booked after the modification date
